Start With Elbert County Court Records
Elbert County court records do not live in one public database. The free Colorado Judicial Branch Docket Search is the first stop for court dates and docket-level lookup. It can be filtered to the 23rd Judicial District, Elbert County, Elbert County Courthouse, and either District Court or County Court. It is useful for upcoming hearings and public docket settings, but it is not a full document library.
For a fuller register of actions, CoCourts offers paid Colorado court data from the Judicial ICON system. Elbert County coverage begins in 1995 for county court and district court in the CoCourts coverage table. CoCourts can show case status, parties, charges, plea, disposition, sentence date, and scheduled events, but it excludes sealed, juvenile, and probate case types. Certified copies, older files, probate files, divorce copies, and document requests still route to the Clerk of Court.
- Use the docket search when the goal is a hearing date, court location, or public setting.
- Choose 23rd Judicial District, Elbert County, and the right court type if known.
- Add a date range plus one more filter, such as party name, case number, business name, or attorney.
- Use CoCourts for a paid register of actions when the case type is covered and not restricted.
- Contact the Elbert County Clerk of Court for copies, certification, probate files, sealed-access questions, or missing records.
The Colorado Judicial Online Payment System is a separate tool for court fines, fees, costs, restitution, and traffic-ticket payment lookup. The Elbert County Clerk and Recorder Self Service portal is also separate. It covers recorded documents and county clerk files, not court case pleadings.
Elbert County Court Records Search Fields
The statewide docket form is exacting. A date range alone is not enough. The posted rule says at least one filter in addition to date is required, so a useful Elbert County court records search usually includes a party name, case number, court type, business name, or attorney filter. Case-number search is split into year, case class, and sequence instead of one free-form box.

That access guide matters because it separates public case-index information from documents that must be requested through the court.
Types of Elbert County Court Records
Elbert County court records are split by case type and court level. District Court handles felony criminal cases, larger civil matters, domestic relations, juvenile, probate, mental health matters, and appeals from county court. County Court handles misdemeanors, traffic infractions and offenses, felony complaints before transfer or bindover, protection orders, small claims, and county-court civil cases. Municipal cases from Elizabeth, Kiowa, or Simla may be separate from the state court system.
Some court records are only partly visible online. Civil and criminal case indexes may appear in CoCourts, while probate case types are excluded there. Juvenile records are generally restricted. Domestic relations files may show public docket entries but protect financial account numbers, minor-child information, protected addresses, and sealed filings. Traffic matters may be searchable by ticket or case number through payment tools, but a court traffic record is not the same as a Colorado DMV driver record.
- Civil records can include complaints, answers, motions, orders, judgments, liens, writs, garnishments, and appeals.
- Criminal records can include charges, advisements, bond, hearings, motions, plea entries, dispositions, sentences, fines, costs, restitution, and warrants.
- Family records can include divorce petitions, summons, parenting plans, support orders, decrees, and post-decree motions.
- Probate records can include estate petitions, wills, letters, inventories, accountings, guardianship files, and conservatorship files.
- Traffic records can include citations, court dates, pleas, dispositions, fine amounts, costs, and failure-to-appear entries.
What Elbert County Court Records Show
A court record is more than a name search result. Elbert County court records can show the court, case number, case class, filing date, close date, status, judge or magistrate, agency, parties, charges, plea, disposition, sentence date, scheduled events, and financial summaries. Full pleadings, motions, orders, exhibits, decrees, and certified copies are not generally delivered by the public CoCourts result. The official CoCourts FAQ also says Social Security numbers, street addresses, nonparty participants, sealed filings, suppressed filings, confidential filings, and detailed financial data are excluded.

Use that source for index-level case data, then contact the clerk when a certified document or full case file is needed.
Public Access for Elbert County Court Records
Colorado court access is governed by court-specific rules as well as public-record statutes. Chief Justice Directive 05-01 and P.A.I.R.R. control public access to court records in the Judicial Branch. County-government records use C.R.S. 24-72-201 through 206, the Colorado Open Records Act. Sheriff criminal justice records use the Colorado Criminal Justice Records Act, C.R.S. 24-72-301 through 309, with custodian review, redaction, and fees where allowed.
The correct custodian depends on the file. Elbert County court case records go to the Clerk of Court. County recorded documents go to the Clerk and Recorder. Incident reports, accident reports, body or audio-video items, and related law-enforcement records go through the Sheriff's criminal justice records process. If an active criminal case is pending court disposition, the sheriff's page says the requester may be referred to the District Attorney's Office for discovery.

Those CORA sources are helpful for county files, but Judicial Branch court records still follow the court access framework.
Restricted Elbert County Court Records
Not every Elbert County court record is public. CoCourts excludes juvenile case types, sealed cases, probate case types, and sealed, suppressed, or confidential filings. Adoption records are confidential. Mental health proceedings are handled by District Court but are restricted because of sensitive personal and medical information. Protected addresses, Social Security numbers, financial account data, victims, police officers, jurors, and minor information can be redacted or withheld.
For sealing questions, the Colorado Bureau of Investigation points to C.R.S. 24-72-705 for sealing criminal justice records other than convictions and C.R.S. 24-72-706 for sealing criminal conviction records. A person usually needs Judicial Branch sealing forms, a verified criminal history when required, a custodian list, and a filing in the court that handled the case. Sealing restricts public access. It does not always erase the record for every law-enforcement, court, or licensing purpose.

Elbert County Court Record Requests
Direct requests go to the Elbert County Clerk of Court when the issue is a case file, certified copy, probate record, divorce file, older file, or access question. The Clerk of Court is at the courthouse in Kiowa. Research questions are routed through the court research email listed by the Judicial Branch. Elbert County Combined Courts does not accept faxed documents, so filing and copy requests should not be planned around fax delivery.

That portal offers free indexes and watermarked images, while clean copies and registered-user subscriptions are separate county-recording services.
