Elbert County court records include civil, criminal, domestic relations, probate, traffic, juvenile, mental health, small claims, protective order, name-change, and appeal materials. The public access level is not the same for each type. Elbert County Public Access Rules

Court access in Elbert County is governed by Colorado court rules and open-records law. Restricted Elbert County Records

Some Elbert County court records are not searched like ordinary public files. CoCourts excludes sealed cases, juvenile cases, and probate case types. Social Security numbers, street addresses, victims, police officers, jurors, suppressed filings, sealed filings, confidential filings, and detailed financial information are omitted or restricted. Elbert County Sheriff Records

Elbert County Marriage Probate

Marriage records and licenses are handled by the Elbert County Clerk and Recorder Recording Office, not the court clerk. Divorce records are different. The county Recording page directs divorce questions to the Clerk of Court because divorce is a District Court domestic relations case. Probate is also handled through the Probate Division of District Court, and the Elbert County staff page identifies Lynda Eichler as Probate Registrar.

The Clerk and Recorder Self Service portal can help with recorded documents, watermarked images, and purchased clean copies. Court divorce and probate files require the court side of the house. Probate is especially important because CoCourts says probate case types are not included in its public search product, so a courthouse request may be needed even when a docket setting can be found online.

County administrative hours are not the same as court hours. Many county offices list Monday through Thursday public hours, while the courthouse lists Monday through Friday court hours. Check the office before making a rural drive to Kiowa.

Elbert County Court History

Elbert County was established on February 2, 1874, and Kiowa remains the county seat. The current jail was built in 1984, while the judicial district structure changed much more recently.

The 23rd Judicial District became official on January 14, 2025. It was formed from Douglas, Elbert, and Lincoln counties leaving the 18th Judicial District, and it was described in official local material as Colorado's first new judicial district in more than 60 years. George Brauchler was sworn in as District Attorney that same date, and Rory N. Devlin later became Elbert County Court Judge for Division A.
